1. Definitions
- "eSIMLLY," "we," "us," or "our" refers to the operator of the eSIMLLY platform.
- "You" or "user" refers to any individual or entity using our services.
- "Services" refers to the eSIM plans, connectivity services, and related features provided by eSIMLLY.
- "eSIM" refers to an embedded SIM profile that allows your device to connect to a mobile network without a physical SIM card.
- "Plan" refers to a specific eSIM data package purchased through our platform.
2. Acceptance of Terms
By creating an account, purchasing a plan, installing an eSIM, or otherwise using our services, you confirm that you have read, understood, and agree to these Terms and Conditions and our Privacy Policy. If you are using our services on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.
3. Eligibility
To use our services, you must:
- Be at least 18 years old, or have the consent of a parent or legal guardian
- Own or have authorized access to a compatible eSIM-enabled device
- Provide accurate, complete, and current account information
- Have the legal capacity to enter into a binding contract
- Comply with all applicable laws, regulations, and these terms
4. Service Description
eSIMLLY provides eSIM-based mobile data services that allow users to access mobile internet in supported countries and regions. Our services include:
- Access to eSIM data plans for travel and local use
- eSIM profile delivery and installation support
- Account management, order history, and usage tracking
- Customer support and troubleshooting assistance
eSIMLLY is a data service provider. We do not provide voice calling or SMS services unless explicitly stated as part of a specific plan. Network coverage, speed, and availability depend on our partner mobile network operators in each region.
5. Account Registration and Security
You may need to create an account to use certain features. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information as necessary
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access or use of your account
- Be responsible for all activities that occur under your account
eSIMLLY reserves the right to suspend or terminate accounts that contain false information or are used in violation of these terms.
6. Orders, Payments, and Pricing
6.1 Pricing
All prices are displayed in the currency selected at checkout and are subject to change without prior notice. Applicable taxes, currency conversion fees, or payment processing fees may be added where required by law or payment providers.
6.2 Payment Processing
Payments are processed securely through Razorpay. By completing a purchase, you authorize eSIMLLY and our payment processor to charge your selected payment method. You agree to comply with Razorpay's terms and conditions.
6.3 Order Confirmation
Upon successful payment, you will receive an order confirmation and instructions to install your eSIM. You are responsible for reviewing your order details before completing the purchase.
6.4 Billing Disputes
If you believe you have been charged incorrectly, please contact us at [email protected] within 14 days of the transaction. We encourage you to resolve billing issues directly with us before initiating a chargeback with your bank or payment provider.
7. eSIM Installation and Activation
You are responsible for ensuring that your device is eSIM-compatible and unlocked before purchasing a plan. Once an eSIM profile is installed or activated, it may not be transferrable to another device.
eSIMLLY provides installation guides and support, but we cannot guarantee successful installation on every device. Network activation may require a stable internet connection during setup.
8. Fair Use and Prohibited Activities
Our services are intended for personal, non-commercial travel and local use. You agree not to:
- Use our services for any unlawful, fraudulent, or harmful purpose
- Resell, redistribute, or sublicense our eSIM plans without authorization
- Share your account credentials or eSIM profiles with unauthorized third parties
- Attempt to interfere with, disrupt, or bypass our systems or security measures
- Use automated scripts, bots, or scrapers to access our platform
- Engage in excessive or abusive usage that negatively affects network performance
- Violate any applicable local, national, or international laws while using our services
9. Service Availability and Network Coverage
We strive to provide reliable eSIM connectivity, but actual availability, speed, and quality depend on the local network infrastructure and partner operators in each destination. Coverage maps are provided for reference and may not reflect real-time network conditions.
We do not guarantee uninterrupted, error-free, or secure service. Service may be temporarily unavailable due to maintenance, network issues, or circumstances beyond our control.
10. Refunds and Cancellations
Refunds and cancellations are governed by our Refund Policy. Please review it carefully before making a purchase. By purchasing a plan, you acknowledge and agree to the refund terms.
11. Intellectual Property
All content, designs, trademarks, logos, software, and other materials on the eSIMLLY platform are owned by or licensed to eSIMLLY and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without our prior written consent.
12. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By agreeing to these terms, you also consent to our privacy practices.
13. Limitation of Liability
To the maximum extent permitted by applicable law, eSIMLLY and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services.
Our total liability for any claim arising from your use of the services shall not exceed the amount you paid for the specific plan giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless eSIMLLY and its affiliates from any claims, damages, liabilities, costs, or expenses arising from your use of our services, your violation of these terms, or your infringement of any rights of another person or entity.
15. Termination
We may suspend or terminate your access to our services at any time, with or without notice, for any reason, including violation of these terms. You may also stop using our services at any time. Upon termination, your right to use the services will immediately cease, but sections related to liability, indemnification, and intellectual property will survive.
16. Changes to These Terms
We may update these Terms and Conditions from time to time. We will post the revised version on this page and update the "Last updated" date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
